I founded The Koplow Law Firm in 2005 after working as a DUI prosecutor for the state. That background allows me to assess how prosecutors build a case, which assumptions support their theory, and where the evidence may fall short of proving the filed charge.

The Scottsdale Drug DUI Court Process
A misdemeanor case in Scottsdale City Court generally begins with an arraignment, where the court addresses the charge and the defendant’s rights before a plea is entered. After a not-guilty plea, the court may schedule a pretrial conference to discuss the case and a possible resolution. Depending on the facts and procedural history, the case may then proceed through motions, negotiations, or trial.
Discovery & Charging in Scottsdale
Discovery may include the citation, police reports, witness information, video, chemical-testing records, and laboratory materials. Scottsdale’s Prosecution Division handles misdemeanor DUI charges arising within the city. Depending on the charge, felony cases may be prosecuted by the Maricopa County Attorney’s Office or the Arizona Attorney General’s Office.
The court, schedule, and available proceedings depend on where the alleged conduct occurred, the filed charge, prior convictions, and any alleged aggravating circumstances.
The Separate Arizona Driver-License Process
The criminal charge and the Arizona Motor Vehicle Division matter are separate proceedings. Arizona implied consent rules can produce a license suspension without a criminal conviction, and resolving the court case doesn’t necessarily resolve the administrative matter.
The Arizona Department of Transportation states that a person generally has 30 days from the suspension notice to request a hearing. Potential consequences differ depending on whether testing occurred, testing was refused, or a conviction is later entered. I review the suspension notice, test-request information, collection timeline, and surrounding circumstances when evaluating the license issue.
